A Carroll County Grand Jury has indicted a 63-year old Carrollton woman on four counts for her alleged role in the shooting death of her 77-year old husband this past January.
Police initially charged Mary Ann Agan with felony involuntary manslaughter and reckless conduct. But, last week, the grand jury indicted Agan on malice murder, felony murder, aggravated assault and possession of a firearm during the commission of a felony.
On Saturday January 25th, Carrollton Police found James Agan inside of a home on Oxford Square with a gunshot to his chest.
The man’s wife – who was also in the home – allegedly stated that her husband had been showing her operations of a revolver – and the gun fired once, striking the male.
According to the initial warrants, Mary Agan was accused of inappropriately handling a Herbert Schmidt .22 Revolver while intoxicated. This resulted in the gun accidentally being fired into James – causing his death. The warrant further claims that Mary stated – she was kidding… and holding the gun to James’ chest – threatening to shoot him if he did not get into the shower.
The recent indictment suggests the grand jury believes there is enough evidence available that shows Agan caused the death of her husband with malice aforethought.
Dr. James Agan is a former city councilman and mayor of Bowdon. He retired from working with the University of West Georgia as the Director of Continuing Education.
Bond has been denied twice for the suspect. Mary Agan has spent 207 days in the Carroll County Jail.
